Dispute Review Boards (DRBs) are increasingly used in the construction industry in an effort to prevent lengthy and costly arbitration and litigation. The intent is to resolve disputes as quickly as they arise and to keep the project moving forward with minimal delay. But the presence of the board does not in itself ensure that all disputes will be resolved quickly and to everyone’s mutual satisfaction—leadership skills also factor in how the board resolves disputes and to whose benefit.
Imagine the following: A construction company has used a DRB for the last few years on several large projects with mixed results. The overall costs of litigation and arbitration have gone down, but not all projects have the same kind of success with the DRB in place. It appears some of the construction managers are more effective at interacting with the DRBs than others. The firm has set up a task force to examine how to effectively use the DRB, and they have asked you to assess the qualities a leader should have to use the DRB effectively and to present your findings to the task force.
