Susa Hansson leased an apartment in Austin, Texas, for $1,000 per month, signing a periodic tenancy agreement with the landlord. In December, the first month of occupancy, Susa found that the heat was sporadic. She did not inform the landlord because her neighbors had already put in a request to fix the heat in the building.

By May 30, she had had enough problems and sent an email to the landlord saying she was moving out the next day since she found the apartment uninhabitable. She further stated that she wanted her 2-month deposit back and left her parents’ address for the landlord to send payment. Susa abandoned the apartment the next day after having sent the email. The landlord refused to return her deposit and is taking her to small claims court. In the interim, he rented her apartment starting July 1.
